Personal information are only stored electronically on our computer system behind Firewalls, 2048 Bit v3 SSL encryption, passwords, anti-virus software and email filters act to protect all our electronic information.

 

We do not store credit card information, we securely submit credit card information to our bank for processing.

1.2 “Buyer” or “You” refers to the person or company to whom the Products and/or Services are sold or supplied;

1.3 “Seller” means Planet Friendly Packaging Pty Ltd ACN 659 283 904 ABN 826 592 839 04;

1.4 “Price” means the Price payable for the Goods as agreed between the Seller and the Buyer in accordance with clause 6 below.

1.5 “GST” means the Goods and Services Tax assessable under the GST Law;

1.6 “GST Law” means a New Tax System (Goods and Services Tax) Act 1999, a New Tax System (Goods and Services Tax Transition Act) 1999 and all associated legislation , subordinate legislation and administrative rulings;

1.7 “Products” includes disposable food service items and packaging;

1.8 “Supplier” means BioPak Pty Ltd; and

1.9 "Website" means www.planetfriendlypackaging.com.au

The following are the terms on which Planet Friendly Packaging will supply, and Customer must acquire Products.

2. General

The content of the pages of this website is for your general information and use only. It is subject to change without notice.

Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Your use of any information or materials on this website is entirely at your own risk, for which we shall not be liable. It shall be your own responsibility to ensure that any products, services or information available through this website meet your specific requirements.

This website contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these terms and conditions.

3. Register an Account

3.1. Registration of an account on the Website is for users residing in Australia only.

3.2 To create an account on the Website, the Buyer is required to agree to the following Terms and Conditions and complete the registration process. The registration of the Buyer's account becomes valid upon the successful acceptance of the online registration, and the subsequent confirmation email sent by the Seller, acknowledging the account's activation.

3.3. The Buyer shall be responsible for creating an account and a secure password, which will be utilised for all transactions on the Website.

4. Ordering

4.1. An account holder is permitted to place an order to purchase Products from the Seller via the Website ("Order") at any time. Upon placing an Order, the Seller will promptly send the Buyer an email to confirm the receipt of the Order.

4.2 Once the Buyer has submitted an Order, it is important to note that the Order cannot be cancelled or amended.

4.3 However, the Seller retains the right to cancel an Order at any time for any reason before delivery by providing written notice to the Buyer. In such cases, the Seller commits to fully refunding the Buyer for any payments made, including the amount for the Products and any associated freight charges.

4.4 It's essential to understand that in the event of the Seller cancelling an Order, the Seller shall not be held liable for any loss or damage, which includes Consequential Loss, resulting from the cancellation.

5. Products

5.1. The Products are made available for purchase exclusively in full carton quantities. 

5.2 Please be aware that the images displayed on the Website are intended for illustrative purposes. The Seller does not provide a guarantee that these images accurately represent the true colour or fully convey the complete design or available options related to the Products.

6. Price and Payment

6.1. The Price for the Products will be clearly indicated on the Website at the time of placing an Order and is denominated in Australian Dollars (AUD). It is important to note that the Price excludes the Goods and Services Tax (GST).

6.2 While the Seller takes all reasonable measures to maintain accurate details, descriptions, and prices for the Products on the Website, errors may occasionally occur. In the event that the Seller identifies an error in the Price of any Products that the Buyer has ordered, the Seller will promptly notify the Buyer. The Buyer will then have the option to either confirm the Order at the corrected price or cancel it. If the Seller is unable to reach the Buyer, the Order will be treated as cancelled. Should the Buyer opt to cancel the Order and has already made a payment, the Seller will issue a full refund to the Buyer through the original payment method.

6.3 The Seller strives to ensure that the Products listed on the Website are up-to-date. However, it's important to note that the Seller cannot guarantee the availability of all the Products advertised on the Website.

6.4. The Seller retains the right to modify the Price of any Products at its discretion, with such changes becoming effective immediately upon the updated Price being posted on the Website.

6.5 Freight charges will be an additional cost in addition to the Price, and these supplementary charges are explicitly presented where relevant, inclusively calculated in the 'Total' cost.

6.6 Both the Price and any applicable freight charges are to be settled upon placing an Order through the Website. The Website accepts payments made via Visa, Mastercard, and Amex.

6.7 It's important to note that the Seller will not accept any Order unless the relevant Price and freight charges have been paid in full, except when otherwise agreed upon for account holders with specific payment terms.

7. Delivery

7.1 The Seller’s standard delivery times for all orders received before 9am are 1-2 days Metro  |  2-3 days Non Metro  |  3+ days Regional.

7.2 The Seller is reliant upon third party couriers which may result in unexpected delays that are beyond the Seller’s control. Delivery times provided as standard estimates should be regarded as approximate, and the Seller shall not be held responsible for any loss or damage, including Consequential Loss, resulting from delivery delays or the inability to deliver the Products, whether in part or in full, due to circumstances beyond the Seller's control.

7.4 The Buyer is required to provide a delivery address within Australia. The final freight charge will be automatically computed during the checkout process, taking into account the delivery location and the Order's size. Except as stated in clause 6.2, it is important to note that all freight charges are non-refundable.

Please note: All PLA cold cups, straws, deli bowls & lids are extremely heat sensitive. These products should not be left outdoors. If you are unable to immediately move these products indoors after delivery we recommend you make alternative arrangements. The Seller or Supplier will not accept responsibility should these products be damaged due to heat exposure as a result of them being left unattended.

 8. Stock Returns for Credit

8.1 Products can only be returned to the Seller for credit within 7 days from invoice date even if the Seller is at fault. If the Seller is not at fault and the Buyer wishes to return product, subject to the rest of this clause being adhered to, the Buyer will:

1.1. Pay the cost of freight of the Products both to them and back to Seller, as well as a $5.00 ex GST per carton restocking / administration fee if returning for Credit;

OR

1.2. Pay the cost of freight of the Products back to the Seller  if returning for credit and then received a replacement item of the same quantity.

8.2 Returned products can only be credited at the value equivalent to the current market value of the products.

8.3 Damaged Products are not eligible for return. Products to be returned must have a returns authorisation (RA) number clearly visible on the outside of the package (NOT on original carton), and the product must be unopened and in a re-sellable condition acceptable by the Seller.

8.4 Any Products that have been written on or defaced by You or your courier will not be eligible for return.

8.5 The Seller only accepts complete cartons with no items missing. The Seller does not accept for credit, sleeves of products nor individual items.

8.6 Approved product returns must be returned to The Seller within 3 days of the RA number being issued or the Products will be declined and returned to You at your cost. 

8.7 All returns outside the above conditions are subject to a minimum 20% restocking fee, if and only if, the Seller agrees to accept the return at the sole discretion of the Seller.  The Seller is under no obligation to accept returns of Product from Buyers.

9. Incorrect, Short Supplied Stock Claims

9.1 The Seller must be advised of any Incorrect or Short Supplied Stock Claims within 48hrs of the receipt of order.

9.2 All Incorrect or Short Supplied Stock Claims must be submitted along with the following supporting documents:

a. Original Sales &/or Invoice Number

b. Additional supporting documents can also include e.g. photos, proof of deliveries

10. Warranty

10.1  The Supplier warrants that all Products supplied are fit for purpose.

10.2  Should any Products not meet the Buyers requirements for this purpose, then the Seller will replace the Products at no cost to the Buyer or provide the Buyer with a full refund at the Buyers preference.

The Planet Friendly Packaging Pty Ltd mobile message service (the "Service") is operated by Planet Friendly Packaging Pty Ltd (“Planet Friendly Packaging Pty Ltd”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Planet Friendly Packaging Pty Ltd’s SMS/text messaging service, you agree to receive recurring SMS/text messages from and on behalf of Planet Friendly Packaging Pty Ltd through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Text messages may be sent using an automatic telephone dialing system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Planet Friendly Packaging Pty Ltd. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with text messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to SMS/text messages, including charges from your wireless provider.

You may opt-out of the Service at any time. Text the single keyword command STOP to PFPackaging or click the unsubscribe link (where available) in any text message to cancel. You'll receive a one-time opt-out confirmation text message. No further messages will be sent to your mobile device, unless initiated by you. If you have subscribed to other Planet Friendly Packaging Pty Ltd mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.
